I am not sure this will affect you only negatively.

Because myself, as a Behringer customer of the Neutron, follows the company because I have some interest in some of their upcoming "original" designs like the proton and brc32, which were supposed to be ready for production 482 years ago..

So I read about their new software synth and thought let's gave it a try and man what a shitshow it was.

I think the whole process of installing and uninstalling it again took less then ten minutes.

I was actually that bad that I went to look for a thread on KVR to tell people it's just not worth installing it.

And in this thread I found out about Saurus and your company.

So I went to have a peak at your website and I decided to give Icarus a testrun. And all I can say is I am quite impressed. I think I went to sleep as late as 4.30 a.m and you might have actually gained a customer instead.

So yeah, ofcourse you could go after them but you will be fighting Goliath which is gonna cost a lot of stress and money.

Maybe it's an idea to take advantage of the momentum and spread the word that it is a possible clone of the much better Saurus and that you are actually considering to go after them. I think a lot of media sites would be interested in publishing this.

Maybe even put Saurus on a supersale.., I dunno ?

But I would really try to gain as much attention towards your company as possible through this Behringer softsynth release..

IANAL but this looks like a "trade dress" issue to me. If customers get confused about the origin of a product based on how it looks, that's reason for a lawsuit (if you can prove it indeed negatively affects your reputation or sales) or at least a cease-and-desist nastygram.

Unfortunately, Behringer looks like it's based in the Philippines now and/or Dubai, so your legal options may be limited. The T&C (or privacy policy) on their website have an address for sending legal correspondence.

Meanwhile they have taken the website with the plugin down. This was not done upon our request.

I heard that the reason some companies are so aggressive about protecting their IP is that if they don't, it becomes like squatters living in other people's houses--the people who are copying actually gain some arguable rights. If you are feeling serious about wanting to stop this, the sooner you act, the better.
C/R, dongles & other intrusive copy protection equals less-control & more-hassle for consumers. Company gone-can’t authorize. Limit to # of auths. Instability-ie PACE. Forced internet auths. THE HONEST ARE HASSLED, NOT THE PIRATES.

You never know. Things might turn against them and to your side just by word of mouth tide. They almost cloned the Arturia "Key Step". Did Arturia loose sales on that ? I don't think so. Just the noise and hype around the controversy maybe made the Key Step more popular. Just a guess. Well it's certainly not less popular.

Similartlities I see are merely superficial. An increasing length of pot marks and a fake blue LCD screen. Typefont, layout, name, etc etc are all different.

Legally, the issue is whether these similarities confuse and mislead customers, which according to the OP it does:
Appearently many people are thinking that it is a new version of the Tone2 Saurus plugin. I got asked for several times if I did the graphics or the sound engine.
Whether this confusion also causes harm to the company is not clear yet.
